Nearly all California employers must establish and implement a Workplace Violence Prevention Plan (WVPP) by July 1, 2024. Employers must maintain a WVPP that includes: prohibiting employee retaliation, accepting and responding to reports of workplace violence, employee workplace violence training and communication, emergency response, workplace violence hazard assessments and other requirements, such as maintaining a Violence Incident Log. Compliance requires that your WVPP is in writing and accessible to employees. Your plan may be a stand alone document or can be included in your existing Injury and Illness Prevention Plan (IIPP). CAL/OSHA has provided a model plan and resources on their website. The following types of entities are exempted from the WVPP requirement:
- Teleworking employees working from a location of the employee’s choice (not under employers control).
- Employment locations with less than 10 employees that are not accessible to the public.
- Healthcare facilities (already covered by Cal/OSHA’s Violence Prevention in Health Care standard).
- Law enforcement agencies
- Department of Correction and Rehabilitation facilities.
