San Francisco Employers: Annual Reporting Deadline Approaching

San Francisco employers covered by the Fair Chance Ordinance (FCO) or the Health Care Security Ordinance (HCSO) should prepare for the SF’s annual reporting requirement. The 2025 Employer Annual Reporting Form, available on April 1, 2026, and must be submitted to the Office of Labor Standards Enforcement (OLSE) by May 1, 2026. Employers that miss the deadline may face penalties of $500 per quarter.

Fair Chance Ordinance (FCO)

  • Employers with 5+ employees.
  • Rules regarding applicants’ and employees’ arrest and conviction record(s) and related information.

Health Care Security Ordinance (HCSO)

  • Employers (20+ employees) and nonprofits (50+ employees).
  • Employers must spend a minimum amount on health care for employees who work 8 or more hours per week in SF.

The annual report gives OLSE a snapshot of employer compliance with both ordinances. For employers subject to the FCO, the reporting covers hiring-related information, including background check practices and certain hiring data. For employers covered by the HCSO, the report includes workforce and health care spending information for covered employees working in San Francisco.
