California law has long prohibited enforcement of non-compete agreements against employees and former employees. Under a new law this year, California employers must affirmatively notify in writing both current and past employees who signed unlawful non-compete agreements or clauses that such provisions are no longer valid.
The deadline for notification is February 14, 2024. This new notification requirement applies to all agreements signed January 1, 2022 or later.
